The Failure of the 28-Clause Peace Proposal for Ukraine: Why Peace Negotiations Continue to Stumble

Europe breathed a deep collective sigh of relief on Monday, as the crisis triggered by the presentation of a new 28-article proposal for resolving the conflict appeared – briefly – to have been contained. A American diplomat spoke of "notable headway" after diplomatic discussions in Geneva. On Monday night, Russian leadership made its countermove: another massive barrage of rocket attacks on Kyiv.

The Cycle of Negotiation and Warfare

The chain of conflicting incidents captured the bleak nature of the current period. By day, negotiation efforts are waged: positive announcements are issued from multiple capitals. Immense energy is allocated on managing particular approaches. By night, Russian leadership forcefully demonstrates the world that, for them, conflict continues to be the key method for achieving "resolution".

After-Dark Attacks

As Russia's attack progressed into the early hours of Tuesday, the present situation of Ukraine's defenselessness was revealed. Ukraine is able to track missile launches from across the border, a ability provided through up-to-date information. From observation points, military aircraft that had been deployed to counter approaching cruise missiles roared overhead – modern combat jets supplied to Ukraine by Western partners.

Shortly after, Kyiv's air-defence systems engaged: several firings deployed against a Russian ballistic missile. This was a modern interception technology at work, presumably supplied through Western nations. Every launch jolts you unexpectedly, rattling buildings. The brief panic quickly gives way to grim resignation: maybe the hostile projectile won't hit its mark this time, sparing the city from ruin and another blackout.

Persistent Threats

Not long after, a heavy machine gun engaged a aerial vehicle close by, part of a rapid response unit – probably allied-provided weaponry. Unfortunately, the shots failed to hit the opposing UAV – it pressed on overhead toward its target.

With pauses, this persisted until dawn. Kyiv greeted the morning news: seven people killed, damage and infrastructure problems in numerous residences as a result of the nocturnal offensive. As always, everyone still continued their routines – experiencing conflict. But those 24 hours encapsulated Ukraine's essential dependence on Western support – a reliance that neighboring countries are clearly incapable to fill in the immediate future.

Ineffective Peace Efforts

The detailed framework from US administration provoked deep reactions, discussion and serious worry – and briefly redirected concern from Ukraine's major integrity crisis in years. Yet, we have witnessed similar scenarios, after prior negotiation attempts and multilateral gatherings.

Every new initiative from American administration follows the consistent cycle: a political offensive against Ukraine, which Kyiv, with allied governments, succeeds in resisting. They contain the crisis but never actually win the battle. This trend will, certainly, endure.

Strategic Calculations

It is tempting to accuse certain parties of persistently promoting Kremlin's demands. But that does not seem to be the whole story. Washington functions according to a assumption well known to international relations experts: you cannot win at the negotiating table what you have failed to defend militarily. The American government believes that it is unrealistic to pressure the Kremlin to relinquish the territory that it currently occupies in Ukraine's occupied territories.

The problem is that while recognising this factual reality, American administration does little to deter Moscow, through diplomacy or military means, from believing that the status quo will not change more in its benefit in the coming year.

Divergent Views

Therefore, Moscow is confident that duration works to their advantage – that Ukraine and its partners are coming close to fatigue. Their motivation to accept conditions that does not give them the greatest potential benefit is close to zero. There may be numerous efforts to stop fighting, but they will continue as long as Russia's leader remains highly assured in the outcome.

On the contrary, Kyiv believes that Ukraine can still endure, progressively conceding people and territory but preventing a complete military breakdown until circumstances change in its benefit.

Current Realities

Objectively, there are no real preconditions for a ceasefire. Now, subjective factors are becoming relevant: personal goals to broker a ceasefire and obtain worldwide acknowledgment, and the government's twin challenges – on one hand, not to estrange crucial supporters, and on the other, to rally Ukrainians around the flag against any proposal Kyiv finds unworkable, so that their focus does not switch to internal issues. And although their mission will now be significantly challenging after recent developments, it remains very improbable that this will alter their fundamental strategy.

These two forces are guiding negotiations.

Summary and Prospects

It took a just a single week to kill the suggested clauses of the current initiative. Assertive and inconsistent approach of the matter by US administration, resistance by Ukraine and the remaining European nations, along with pacifying measures of diplomats, and finally, latest revelations, all achieved their purpose.

While new initiatives based on established approaches are imminent, Kyiv, London and other Western governments should reach an essential realization: Ukraine and Europe will only be able to fend off negotiation assaults from Washington that are based on Russian demands and demonstrate particular unwillingness to alter the situation, if they stand together and strengthen their defence capabilities at a significantly accelerated rate. If they do, neither external pressure nor military threats will be able to defeat them. In the meantime, Ukraine's capacity to repel nightly air assaults will, for the foreseeable future, largely rely on sustained allied backing.
